The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and Big Land Investments, LLC (“BLI”) entered into a January 5h Consent Administrative Order (“CAO”) addressing alleged violations of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See LIS No. 26-001.
The CAO provides that BLI operates a car wash and laundromat in Baxter County, Arkansas.
The facility is stated to discharge treated wastewater to an unnamed tributary of Norfork Lake and eventually to the White River. Such discharge is regulated pursuant to an NPDES Permit.
The CAO alleges the following violations:
- Failure to submit a complete permit renewal application by November 2, 2023, violating Part III, Section D, Condition 10 of the NPDES Permit.
- Failure to pay annual permit fees in the amount of $221, along with late charges of $22.10.
The CAO requires that on or before its effective date BLI submit an administratively complete permit renewal application. Further, BLI is required to comply with the existing NPDES Permit until either the effective date of the Permit renewal or the effective date of the Permit termination.
BLI is also required to pay the invoice and late fees within 30 calendar days of the effective date of the CAO. In addition, a civil penalty of $1,000 is assessed which is conditionally suspended by ADEQ if BLI fully complies with the CAO.
