Wastewater Enforcement: Louisiana Department of Environmental Quality and Baton Rouge Milk Processing Facility Enter into Settlement

The Louisiana Department of Environmental Quality (“LDEQ”) and Kleinpeter Farms Dairy, L.L.C., (“KFD”) entered into a Settlement addressing alleged violations of a Louisiana Pollutant Discharge Elimination System (“LPDES”) permit. See SA-WE-20-0023.

KFD is stated to own and/or operate a milk processing facility (“Facility”) located in Baton Rouge, Louisiana.

LDEQ is stated to have issued to KFD a Consolidated Compliance Order & Notice of Potential Penalty on November 17, 2015.

Violations alleged include:

  • Exceedances of the permitted discharge limitations of the LPDES permit as reported by Discharge Monitoring Reports
  • Failure to properly operate and maintain the sewage treatment plant
  • Failure to implement the Stormwater Pollution Prevention Plan
  • Failure to sample the effluent from Outfalls 003 and 004 on a quarterly basis as required by the LPDES permit

KFD denies it committed any violations or that it is liable for any fines, forfeitures and/or penalties.

The Settlement assesses a civil penalty of $60,300 of which $1,800.57 is stated to represent LDEQ’s enforcement costs.
