The Louisiana Department of Environmental Quality (“LDEQ”) and LCS Recycling, LLC (“LCS”) entered into an August 9th Settlement addressing alleged violations of water, solid waste, and spill prevention and control (“SPC”) regulations. See SA-MM-21-0099.
The Settlement provides that LCS owns and/or operates a used cooking oil collection and storage facility (“Facility”) in Mandeville, Louisiana.
The Facility is stated to not have:
- Louisiana Pollutant Discharge Elimination System (“LPDES”) permit
- Authorization to discharge to waters of the state
- Permit/and or authority from LDEQ to operate a solid waste disposal site
LDEQ is stated to have conducted inspections in 2019 and 2020 at the Facility and allegedly identified the following violations at the Facility:
- Caused and/or allowed the discharge of cooking oil to waters of the state
- Failure to notify LDEQ of the above-referenced discharge of used cooking oil
- Failed to prepare and implement a SPC plan
- Failed to take proper remedial action
- Failed to submit a complete application to discharge to waters of the state
- Caused and/or allowed the disposal of regulated solid waste without a permit
- Caused and/or allowed the discharge of stormwater contaminated with used cooking oil to waters of the state
- Failed to implement an adequate SPC plan
LCS does not admit liability under state or federal statute or regulation.
The Settlement assesses a cost to LCS of $9,000.
