No company wants a lawsuit or civil investigative demand over their autorenewal practices. And settling a case for millions or billions of dollars is even worse. In 2025, negative options and subscription offers became one of the top areas of class action lawsuits and Federal Trade Commission (FTC) investigations. The California Automatic Renewal Taskforce, class action plaintiffs, and state attorneys general have increased enforcement with more and more state-wide sweeps and multi-state settlements. Unfortunately for businesses, courts have begun to issue decisions finding widespread autorenewal practices unlawful under the Restore Online Shoppers’ Confidence Act and other laws.
