For employers who operate essential businesses, or plan to re-open their facilities, liability concerns remain a serious consideration. At the same time, employers must determine how to re-open or continue to operate while respecting the rights of employees accorded by applicable laws, including the ADA and OSHA.

In this webinar, members of our Labor & Employment Practice Group will provide a review of potential claims that could be asserted against employers who are operating their businesses by persons who may have contracted COVID-19 from an employee, and the legal standards that could apply to any such claim. After reviewing the laws in various states that have provided liability protections for employers, we will discuss potential steps that can be taken to reduce any potential exposure.

For those employers who are considering re-opening their locations, we will discuss the myriad employment-related issues associated with such a re-opening including what steps can be taken to help ensure a safer workplace, and accommodating employees with disabilities. We will include practical steps for developing a safety program for re-opening / operating a business and attempt to address some of the mystery associated with liability concerns for spreading the virus.
