The last several months have resulted in significant changes for all sectors, and for higher education more than most. Institutions now operate in a different way that is much less centralized having many more endpoints in information systems. While cybersecurity concerns have been front and center for years, the current environment makes that even more true and much more complex.

Please join us in examining the cybersecurity issues in the new environment for higher education. Ben Auton of SpearTip Cyber Counterintelligence will join Jim Shreve, Katie Wendel and Luke Sosnicki to explore the nature of new and expanded risks, some controls to prevent and mitigate risks and some of the legal and regulatory issues presented by the cyber threats. We will also discuss the current cybersecurity efforts of the U.S. Department of Education.

He is passionate about assisting clients in reducing risk and developing effective cybersecurity frameworks and strategy inside their organization.

A Maryville University alumnus, Ben holds both a Bachelor of Science degree in Cybersecurity and a Master of Business Administration (MBA) degree. He continues to serve the University as an adjunct professor of cybersecurity. With a strong desire for continuous education, Ben has attained several industry certifications includingGIACReverse Engineering Malware (GREM), Certified Hacking Forensic Investigator (CHFI), and EnCase Certified Examiner (EnCE). Ben is also active in community events focused on raising awareness about current cybercriminal threats and public exploitation.

Aaron’s practice is dedicated entirely to helping institutions of higher education navigate complex legal and regulatory matters. He has significant experience in the array of federal, state, and accrediting agency laws and standards that govern postsecondary institutions, and is a frequent writer and speaker on topics relating to higher education policy and the federal financial aid programs.

In 2018, Aaron served the U.S. Department of Education as one of 17 negotiators charged with overhauling the Department's complex and controversial "borrower defense" rule. The Department selected Aaron to represent and negotiate on behalf of general counsels, attorneys and compliance officers at postsecondary institutions nationwide.

Aaron regularly represents institutions in administrative proceedings before state licensing entities, accrediting agencies, and the U.S. Department of Education, including matters arising from audits, program reviews, and investigations of the Office of Inspector General.

In support of institutional initiatives, he assists clients in drafting and negotiating a wide variety of agreements, including domestic and international articulation, consortium, licensing, marketing, and agency contracts, and in the case of postsecondary mergers and acquisitions, stock and asset purchase agreements. Aaron also assists with the management of regulatory and government agency relationships, policy creation and implementation, strategic planning, and compliance systems design.

Aaron is a member of the National Association of College and University Attorneys and of the American Bar Association.

Jim Shreve

Jim serves as a trusted advisor to clients facing complex cybersecurity and privacy issues — particularly those in the country's most highly regulated industries. He is the chair of Thompson Coburn's Cybersecurity group, was named a Fellow of Information Privacy, and holds CIPP/US and CIPT certifications from the International Association of Privacy Professionals.

Jim advises all types of companies on the myriad legal concerns surrounding confidential information and how such information is stored and transmitted. Applying the law to rapidly changing technology and software capabilities, Jim provides clients with a profile of their potential risk, then works closely with executive leadership, legal, IT, and compliance information security teams to develop a comprehensive and practical plan for risk avoidance and responding to cyber and data-related issues.

Luke Sosnicki

Luke is an experienced commercial litigator who has successfully litigated commercial disputes of all types. He is also an experienced financial services litigator, having spent most of his career defending banks, mortgage servicers, and other financial institutions in individual and class action cases across the country. He holds a CIPP/US certification from the International Association of Privacy Professionals and provides comprehensive advice on litigation risks related to federal and state data privacy laws, including the California Consumer Privacy Act (CCPA).

Katie Wendel

Katie handles a wide variety of regulatory and transactional work for the nonprofit and for-profit higher education sector, including online education programs, and has extensive knowledge of the laws and policies affecting colleges and universities.

She regularly communicates with the U.S. Department of Education on behalf of clients to assist with Title IV issues and maintaining institutional eligibility with the Department. Katie also helps schools sustain successful student exchange visitor programs.
