With the legalization of cannabis in various states, but the continued classification of cannabis as a controlled substance under federal law, there are many pitfalls to beware of and benefits provided by federal law that business owners are unable to avail themselves of. Relevant here, business owners are mostly unable to avail themselves of the benefits provided by the USPTO, such as trademark and patent registration. This presentation will include a general discussion of the state of the law as it applies to cannabis, federally and in certain states, and that discussion will be followed by multiple hypothetical situations and suggested methods through which practitioners can assist their clients in protecting their intellectual property until cannabis is removed from the Controlled Substance Act, permitting business owners to avail themselves of the benefits of federal law.

Josh is an experienced trial attorney, and a member of the firm’s litigation, intellectual property, and real estate practice groups. While Josh is based in the Sacramento office, he serves various clients throughout the State of California, and across the United States.

As a result, Josh has extensive experience dealing with the United States Patent and Trademark Office and the United States Copyright Office. Josh has also successfully handled various matters before the Trademark Trial and Appeal Board.
