The Arkansas Department of Energy & Environment - Division of Environmental Quality (“DEQ”) and North Central Arkansas Quarry, Inc. (“North Central”) entered into a June 13th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 22-069.

The CAO provides that North Central operates a hot mix asphalt facility (“Facility”) in Mountain Home, Arkansas.

The Facility is stated to operate pursuant to General Air Permit for Minor Source Hot Mix Asphalt Facilities 1912-AGP-000 (“Permit”).

North Central is stated to have conducted an emissions test of its Hot Mix Asphalt Baghouse Plant Stack (SN-01) on November 2, 2021. DEQ personnel are stated to have informed North Central that a review of the emission test report had been performed indicating that the opacity and PM emissions limits at SN-01 were exceeded. This exceedance allegedly violates Specific Condition 18 of the Permit.

North Central neither admits nor denies the factual and legal allegations contained in the CAO.

The CAO requires that within 15 calendar days of its effective date that North Central submit a test protocol for PM and opacity testing at SN-01. Further, within 30 calendar days of the effective date of the CAO, North Central should conduct emissions testing for PM and opacity at SN-01.

The emission test results for SN-01 are required to be submitted to DEQ within 60 calendars days of the effective date of the CAO.

A civil penalty of $6,160 is assessed.
