Air Enforcement: Mississippi Commission on Environmental Quality and Pass Christian Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Chemours Company FC LLC (“Chemours”) entered into a June 30th Agreed Order (“AO”) addressing alleged violations of an air permit. See Order No. 7199 22.

The AO provides that Chemours operates the Export Capacity Project at its facility (“Facility”) located in Pass Christian, Mississippi.

A Permit to Construct for the Facility is referenced in the AO. See Permit to Construct No. 1020-00115. This Permit to Construct is stated to have been issued on March 21, 2011.

The AO references violations of the Emissions Limitations section of the Permit to Construct which include:

  • Exceedance of the PM limit of 6.17 lb/hr
  • Exceedance of the PM2.5 limit of 5.00 lb/hr
  • Exceedance of the PM10 limit of 6.17 lb/hr

The Facility is stated to have submitted results of subsequent successful stack testing of the referenced emission point AC-101 on April 18th. The results were stated to be below the requirements set forth in the Emissions Limitation section of the Permit to Construct.

A civil penalty of $33,750 is assessed.
