The Arkansas Department of Energy & Environment - Division of Environmental Quality and Jason International, Inc. (“JII”) entered into a March 31st Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 23-025.

JII is stated to operate a fiberglass Whirlpool bath manufacturing facility (“Facility”) in North Little Rock, Arkansas.

The CAO provides that JII operates pursuant to an air permit.

DEQ personnel are stated to have conducted a compliance inspection of the JII Facility on July 21, 2022. The inspection is stated to cover the reporting period of August 2020 through July 2022.

The inspection is stated to have determined that JII failed to maintain records of the weekly opacity observations at SN-14 from October 18, 2021, through July 21, 2022.

JII responded to a query regarding the inspection compliance issues by letter dated August 30, 2022, acknowledging the failure. The company stated the Facility’s internal opacity readings chart had been updated.

JII submitted a letter to DEQ on January 20, 2023, requesting a reduction in a proposed civil penalty. The company provided details of financial and work culture issues the Facility has dealt with in the last few years.

JII neither admits nor denies the factual and legal allegations contained in the CAO.

To demonstrate compliance with Specific Condition 28 of Permit R8, JII is required to submit weekly opacity observations records for SN-14. They are required to be submitted for three consecutive months beginning with the month following the effective date of the CAO.

The CAO also assesses a civil penalty of $7,350.
