Air Enforcement: Mississippi Commission on Environmental Quality and Bay St. Louis Carbon Manufacturing Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Calgon Carbon Corporation (“Calgon”) entered into an April 12th Agreed Order (“AO”) addressing an alleged violation of an air permit. See Order No. 7242 23.

The AO provides that Calgon operates a manufacturing facility (“Facility”) in Bay St. Louis, Mississippi.

The Calgon Facility operates pursuant to a Clean Air Act Title V Operating Permit.

Calgon is stated to have been contacted by MCEQ by letter dated November 22, 2022, regarding a violation of its Title V Operating Permit.

The AO alleges that Calgon did comply with Condition No. 3.B.7 by failing to demonstrate compliance with the PM/PM10/PM2.5 limit of 4.0 pounds per hour (3-hour average) during a stack test of Emission Point AA-012 on June 8, 2022.

The Facility is alleged to have emitted 4.15 lbs/hr of PM/PM10/PM2.5 during the stack test.

The Facility is stated to have subsequently demonstrated compliance during a retest on October 5, 2022.

The AO assesses a civil penalty of $22,500.
