On March 2, 2015, the Pennsylvania House of Representatives referred to the House Judiciary Committee HB665, introduced by Representative M. K. Keller, which contains the proposed “fix” to the Power of Attorney statute which will restore the commercial transactions exclusions to provisions requiring notarizations and prescribing non-waivable agent duties. If enacted this would fix the issues with respect to commercial documents containing powers of attorney, including confession of judgment provisions, that arose when the 2014 amendments to the law took effect on January 1, 2015.
