Employers Should Continue To Use Existing Version Of Form I-9 For Now

The current version of the Employment Eligibility Verification Form I-9 shows an expiration date of March 31, 2016. As of today, the U.S. Citizenship and Immigration Services (USCIS) has not yet issued a new version of the Form I-9. In November 2015, USCIS requested and began accepting public comments on their proposed changes to the Form I-9. USCIS is now considering the public comments submitted and will publish a second notice, to which the public will have thirty days to respond. As with the last time the Form I-9 expired in 2013, the USCIS will most likely announce that the current version should continue to be used, even after the listed expiration date, until the new version is announced. The current version of the Form I-9 can be found on the USCIS website: http://www.uscis.gov/i-9. Laner Muchin will provide updates as soon as USCIS issues announcements on this issue.
