Depuis l’entrée en vigueur le 1er octobre 2014 des dispositions de la loi Hamon introduisant une action de groupe en droit français, plusieurs actions ont déjà été initiées témoignant d’un vif intérêt des associations de consommateurs agréées pour ce nouveau dispositif. Reste maintenant à attendre les premières décisions des tribunaux compétents pour mieux évaluer l’efficacité du dispositif d’indemnisation collective créé par la loi Hamon.
Le 3 novembre 2014, une nouvelle action de groupe a été intentée, cette fois-ci par la Confédération Nationale du Logement (CNL) contre le bailleur social 3F, devant le Tribunal de grande instance (« TGI ») de Paris. L’objet de cette action est de contester la facturation par 3F à chacun de ses locataires d’une pénalité forfaitaire d’un montant de 2% du loyer en cas de retard de paiement.
