H-1B Cap Registration Update: USCIS Announces a Second Round of Selections

U.S. Citizenship and Immigration Services (USCIS) announced on July 27 that it will conduct a second round of random selections from the previously submitted FY 2024 H-1B pre-registrations. These pre-registration requests were submitted in the March 2023 time frame as mandated by the agency. USCIS will send an additional announcement after the second round of selections have been completed.

The second round of random selections results from fraud investigations conducted by USCIS into dozens of companies alleged to have colluded to submit registrations for the same foreign national in an effort to increase the odds for H-1B selection for a potential employee. The federal government has indicated that it will be pursuing these companies and prosecuting them for committing fraud on the federal immigration system.

Employers selected in this second-round lottery will be given 60 days from the date of selection notification to file H-1B petitions with USCIS.
