Health Emergency status by force majeure is declared due to COVID-19 and extraordinary measures are established

On March 31, 2020 an Agreement establishing the extraordinary actions that must be adopted to face the sanitary emergency generated by COVID-19, was published in the Federal Official Gazette (FOG). This Agreement was published as a result of the declaration of Sanitary Emergency due to force majeure that was published on March 30th. The Health Emergency will be effective until April 30, 2020.

The following are some of the extraordinary measures that companies must implement:

  1. Immediate suspension of non-essential activities in public, private and social sectors.
  2. The Agreement establishes a list of activities that are considered as essential activities, and, therefore, that can be kept performed.
  3. Gatherings of more than 50 people cannot be held in facilities where essential activities are performed; likewise, a specific measures relating to the National Safe and Social Distancing Program (Jornada Nacional de Sana Distancia) need to be observed.
  4. Individuals over 60 years old, along with any individual in a vulnerable situation, are required to stay home.
  5. Suspension of censuses and surveys.

The provisions of both of the referred Agreements published in the FOG, entered into force on the same day of their publication.
