On September 29th, the Office of the Medicaid Inspector General (OMIG) conducted a webinar entitled, “The OMIG Exclusion and Reinstatement Process.” The webinar provided valuable information on what practices could result in an exclusion, as well as how to apply to have a provider’s name removed from the exclusion list and/or reinstated into the Medicaid program. Importantly, providers facing actions by the Office of Professional Medical Conduct (OPMC) or the Office of Professional Discipline (OPD) should be aware that consent orders and other actions may lead to Medicaid and/or Medicare sanctions. A procedure established by OMIG to accommodate potential actions is addressed in this presentation. As stated in the OMIG power point: “Providers who are in negotiation with either OPMC or OPD may send their proposed consent orders to OMIG’s Office of Counsel (OOC) for a pre-determination of possible Medicaid sanctions.”

As you know, the effects of a Medicaid exclusion are far reaching and generally serve to prohibit employment with any organization that receives Medicaid funding.
