New Jersey Healthcare Regulatory Update - April 2014

As a service to our healthcare clients, the following is provided as a brief summary of regulatory changes published in the New Jersey Register during March 2014. This summary is provided for informational purposes only and the reader is urged to review the entire text of the changes as such changes appear in the New Jersey Register. Further, this summary represents only selected changes that may affect healthcare providers. As such, please be aware that there maybe other regulatory changes that affect healthcare providers that are not mentioned in this summary.

ADULT DAY CARE CENTERS.

On March 17, 2014, the Department of Health issued a notice of the readoption of N.J.A.C. 8:43F "Standards for Licensure of Adult Day Health Services Facilities", with an effective date of January 30, 2014 and expiring on January 30, 2021. 46 N.J.R. 541(b).

AUDIOLOGISTS AND SPEECH-LANGUAGE PATHOLOGISTS.
On March 17, 2014, the Audiology and Speech-Language Pathology Advisory Committee published the adopted amendments to N.J.A.C. 13:44C. Key changes include obtaining licensure in New Jersey if the applicant has a license in another state as well as changes for educational requirements. 46

DENTISTRY

On March 17, 2014, the State Board of Dentistry published a Notice of Receipt of Petition for Rulemaking concerning the scope of dental auxiliaries in an orthodontic office.  Briefly, the petitioner, Dr. Rene Johe, President on behalf of the New Jersey Association of Orthodontists, requested that the Board change its rules to expand the scope of practice of limited registered dental assistants in orthodontics and licensed dental hygienists as well as other changes. 46 N.J.R. 563(a). 

FACILITIES - OUTPATIENT PSYCHIATRIC SERVICES.  

On March 3, 2014, the Department of Human Services, Division of Medical Assistance and Health Services published the proposed amendment of N.J.A.C. 10:52-4.3 "Outpatient Psychiatric Services: Unit Rates."  46 N.J.R. 419(a). 

Public comments are due by May 5, 2014.

HOSPITALS - INPATIENT PSYCHIATRIC SERVICES.

On March 3, 2014, the Department of Human Services, Division of Medical Assistance and Health Services published the proposed re-adoption of N.J.A.C. 10:52A "Psychiatric Adult Acute Partial Hospital and Partial Hospital Services." 46 N.J.R. 420(a).  

Public comments are due by May 5, 2014.

PRIVATE LICENSED FACILITIES FOR PERSONS WITH DEVELOPMENTAL DISABILITIES.
On March 3, 2014, the Department of Human Services, Division of Developmental Disabilities proposed re-adoption of N.J.A.C. 10:47 "Standards for Private Licensed Facilities for Persons with Developmental Disabilities." 46 N.J.R. 417(a). 

Public comments are due by May 2, 2014.
