After 17 months and more than 120,000 public comments, the Department has released its new regulations implementing Title IX of the Education Amendments of 1972. The regulations represent a seismic shift in process and culture, turning campus disciplinary processes into trials. And institutions have just 100 days to implement them.

The regulations will require many institutions of higher education to make significant changes to their policies, practices and training materials relevant to this important topic, all while navigating a global pandemic. In addition to determining how to promptly implement the changes, institutions will need to consider how to most effectively communicate them to their constituencies, while emphasizing their ongoing commitment to all students. And they will have to do so all before the regulations take effect on August 14, 2020.
