New York City Employers Must Post And Distribute Anti-Sexual Harassment Notices

The New York City Commission on Human Rights has published a notice and information sheet that all New York City employees must post and provide to new employees as of September 6, 2018. 

As detailed in our April 2018 alert, New York City enacted the Stop Sexual Harassment in NYC Act, mandating sexual harassment prevention programs for all New York City employers.  Among other things, the law requires all city employers to conspicuously post a notice of rights and responsibilities in the workplace. Employers also must provide an anti-sexual harassment information sheet to all new employees. Employers must comply with these new requirements as of September 6, 2018. 

The Commission recently published the notice that must be conspicuously posted and the information sheet that must be given to new employees. The law requires employers to display the notice in English and Spanish, but as of now only the English versions of the notice and information sheet have been published by the Commission.    

The Commission also published a webpage with additional sexual harassment resources. It includes information about the Commission’s compliance process, scenarios to help identify instances of sexual harassment and links to the New York State Division of Human Rights and United States Equal Employment Opportunity Commission web pages.

Employers in New York City should take steps now to comply with these requirements. Employers can comply with the requirement that the information sheet be given to all new employees by including it in their employee handbook or by giving it to new employees separately with their new hire paperwork.
