As reported in DWT’s earlier advisories in April and May, New York City is strengthening its already robust laws against sexual harassment. To that end, the New York City Commission on Human Rights has released the mandatory Poster and Fact Sheet referenced in the recently enacted Stop Sexual Harassment in NYC Act (the “Act”).

Effective September 6, 2018, all New York City employers will be required to (i) conspicuously display the Poster in the workplace and (ii) distribute the Fact Sheet to all new employees upon hire. The Fact Sheet need not be distributed to employees as a stand-alone document. It can be included in an employee handbook, provided the handbook is distributed to each employee upon hire.

Effective April 1, 2019, the Act also requires employers with at least 15 employees (regardless of where they are located) to conduct annual anti-sexual harassment training for all New York City employees.
