OSHA Enforcement: Milwaukee, Wisconsin Battery Manufacturer Proposed Penalty Assessment

The United States Occupational Safety and Health Administration (“OSHA”) announced the proposed assessment of civil penalties to C & D Technologies, Inc. (“C & D”) for alleged violations.

C & D is stated to operate a battery manufacturing facility in Milwaukee, Wisconsin.

OSHA is stated to have inspected the facility and identified certain violations. They are alleged to have included:

  • Failure to implement sufficient controls to prevent exposure
  • Failure to monitor ventilation for the presence of lead
  • Failure to post warning signs in work areas that exceeded the permissible exposure limit
  • Failure to provide respiratory protection
  • Failure to install machine guarding
  • Failure to guard floor holes

OSHA proposes to assess civil penalties of $147,822.

C & D has 15 days from receipt of the citations to comply, request an informal conference with OSHA’s Area Director, or contest the findings before the independent Occupational Safety and Health Review Commission.
