Yesterday the Supreme Court issued an order staying the OSHA Emergency Temporary Standard (ETS) that would have required all employers with 100 or more employees to enforce Covid-19 vaccination or testing requirements.
The underlying case can go forward, but the stay may end any realistic chance of enforcement given that the ETS would have expired in early May anyway.
The Supreme Court allowed to stand the separate rule that requires workers in nursing homes, hospitals, and other facilities that receive Medicare and Medicaid payments from the federal government to be vaccinated.
