Under Proposition 65, businesses with more than ten employees, selling any products in California, including online, through catalog shipments, or through a third-party seller or distributor that sells its products, are required to warn consumers about products which contain component ingredients known to cause cancer, birth defects or other reproductive harm.

In November 2017, California passed amended regulations regarding the content of these warning labels. Businesses selling products in California must comply with these regulations by August 30, 2018.

For a more thorough description of the warning label requirements, please see our original alert published in November 2017 on this topic, related here.
