Skin Deep: New York’s New Requirements for Cosmetology Schools and Stylists

On November 17, 2023, New York Governor Hochul signed off on a new law as part of her Health Equity and Opportunity legislative package that will take effect in May 2024. New York will require all cosmetology schools to make natural hair education a part of their curriculum. Cosmetology schools must update their curriculums to include long-neglected natural hair training.  Education and training are required regarding the provision of services to individuals with all hair types and textures, including, but not limited to, various curl or wave patterns, hair strand thickness, and volumes of hair.  The legislation reflects an effort to foster inclusivity and ensure that all salon customers receive the same level of attention and expertise. Previously, many New Yorkers faced fewer options at the salon. Now, all New Yorkers will have the ability to walk into any salon and know that their hair is going to be taken care of.

Here are some key takeaways from the new law:

  • it is effective six months from November 17, 2023;
  • it applies to current and future cosmetology students who have yet to graduate;
  • it does not apply to current stylists, but they are encouraged to receive additional education to learn how to work with all hair types; and,
  • cosmetology schools that are not compliant may face disciplinary action and fines.

Cosmetology schools and stylists (and their insurers) would be wise to review the new legislation and focus on ramping up their educational requirements and training to avoid liability. New York is changing the standards for the salon industry. The legislature is considering the work of licensees and trainees within salons to ensure the health, safety and welfare of the public, including the licensees and trainees when they are working within such establishments.
