Happy New Year! We hope you and your family enjoyed the holidays. Q4 of 2022 did not see significant new state legislation enacted. The FTC, however, issued a strong notice about where it intends to go in the restrictive covenant space in 2023 (and beyond) and several trade secret verdicts deserve attention. In addition, could a Washington restrictive covenant class action be a harbinger of things to come?
