Recently, the American Immigration Lawyers Association sat down with the State Department to discuss priority dates and visa demand for fiscal year 2013.  Of particular interest were EB5 numbers – particularly for nationals of China. Worldwide usage is up 75% over the past year and numbers for China are moving at an incredible pace.  Is a cutoff possible if usage increases? There does not appear to be any relief in sight in the EB3 or EB2 categories for nationals of India or China, though the EB1 category appears to be okay for now as open EB1 numbers from other countries can “fall across” to satisfy the need from India and China.
