The Mental Health Parity and Addiction Equity Act (MHPAEA) requires health plans to provide mental health benefits, including coverage for substance use disorders (SUDs), that are in “parity” with medical and surgical benefits. The exploding opioid and SUD crisis coupled with the soaring rates of mental health conditions post-COVID have put mental health parity in the spotlight, even as understanding and complying with its requirements have become increasingly challenging.

In July, the Departments of Treasury, Labor, and Health and Human Services published proposed regulations intended to clarify and improve compliance with MHPAEA, a lengthy new 2023 MHPAEA Comparative Analysis Report to Congress and a Technical Release. What new insights can we glean from these documents? What new requirements will be imposed if the proposed regulations go into effect?
