The UK-US Bilateral Data Sharing Agreement (Agreement) came into force from over the Summer. In certain circumstances it enables law enforcement in the UK and U.S. to seek domestic court orders to require production of data direct from communication service providers in the other jurisdiction. In doing so it heralds a potential step change in transatlantic law enforcement and is supposed to dramatically speed up cross border criminal investigations. Whether it will do so is unclear: significant elements of the procedure are uncertain and raise a host of troublesome compliance issues for British and American corporates.
Simmons & Simmons and Wiley’s law enforcement and data protection specialists will give a rundown of the potential implications of the Agreement and share some particular insights gained from extensive experience working on cross border investigations from both sides of the fence – for and against law enforcement.
