SBA Considering Extending Comment Period for Proposed Rule on the Limitations on Subcontracting

Although not yet official, we anticipate that SBA will grant an extension until April 6th for submission of comments on the Proposed Rule on the Limitations on Subcontracting.  We’ll continue to work with our clients and industry partners to ensure that SBA receives meaningful commentary on its proposed changes to the rules and calculations, which will affect the entire small business government contractor community. 

GSA Issues Proposed Rule to Amend Federal Property Management Regulations/Federal Management Regulation; Supply and Procurement

The General Services Administration (GSA) issued a proposed rule to amend the Federal Property Management Regulations (FPMR) and the Federal Management Regulation (FMR) by migrating regulations regarding the supply and procurement of Government personal property management from the FPMR to the FMR, 80 Fed. Reg. 9679. The FPMR will contain a cross-reference to direct readers to the coverage in the FMR. This proposed rule also eliminates material that is not regulatory in nature, is overly prescriptive, outdated, addressed in other policy, or no longer appropriate for today's Government business environment. This case is included in GSA's retrospective review of existing regulations under Executive Order 13563.   Comments on the proposed rule are due April 27, 2015.  

DoD Updates Synchronized Pre-Deployment and Operational Tracker Business Rule

The Department of Defense (DoD) issued an update to the Synchronized PreDeployment and Operational Tracker (SPOT) Business Rules.  Pursuant to the updated Business Rules, when a work visa is required for a contractor employee to perform in a particular country, a company administrator is to now enter the employee’s  visa details into SPOT.  This information is necessary to provide visibility of visa status for contractors supporting ongoing military operations, particularly in countries where transitions are taking place that affect their visa processes. DoD Issues Final Rule to Amend DFARS Domestic Source Restrictions on Certain Naval Vessel Components (DFARS Case 2014-D022)

The Department of Defense (DoD) issued a final rule to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement the statutory domestic source restrictions on acquisition of certain naval vessel components, 80 Fed. Reg. 10391.  The final rule became effective February 26, 2015. 

President Obama Signs Executive Order 13691, Promoting Private Sector Cybersecurity Information Sharing

President Obama has signed Executive Order (“EO”) 13691 in order to encourage more sharing of cybersecurity threat information between the private and public sectors. The purpose of the EO is to promote the development of central clearinghouses for companies and the government to share data and the creation of centers where data can be shared across specific geographic regions, 80 Fed. Reg. 9349

Reg. 9261, February 20, 2015, to add a service (Custodial Service, U.S. Navy, Naval Air Station Oceana and Naval Auxiliary Landing Field Fentress, U.S. Navy, Dam Neck Annex, 1750 Tomcat Boulevard, Virginia Beach, VA; U.S. Navy, Naval Weapons Station, U.S. Navy, Cheatham Annex, 160 Main Road, Yorktown, VA; U.S. Navy, Norfolk Naval Shipyard and St. Juliens Creek Annex, Cassin Ave. and Hitchcock Street, Portsmouth, VA) to the Procurement List.  The addition will become effective March 23, 2015
