With the National Labor Relations Board's fiscal year just concluded and the decisional setbacks of operating with only two members now gone, the Board's recent decisions reveal a new, labor-friendly friendly agenda not only challenging employee choice but employer operating flexibility, the real meaning of agreed-upon contract language, and how best to design and structure operating units within each workplace. Given the Board's new make-up and apparent direction, this Alert offers suggestions for immediate action in response to the troubling results in the cases highlighted and in anticipation of more to come.
