NBA lawsuit against NBA Players Association and selected individual players


The National Basketball Association has filed a Complaint against the National Basketball Players Association and selected players with the United States District Court for the Southern District of New York. The Complaint is styled as a Class Action and seeks among other prayers for relief, a Declaratory Judgment from the court that the current lockout by the owners is lawful and protected from antitrust attack by virtue of the non-statutory labor exemption provided by Section 20 of the Clayton Act, 29 U.S.C. Section 52 as well as Section 6 of the Clayton Act, 15 U.S.C. Section 17, and the Norris-LaGuardia Act, 29 U.S.C. Section 101 et. seq. The Complaint also requests a declaration that because the lockout by the owners involves or grows outs of a labor dispute, that the Norris-LaGuardia Act deprives the federal courts of jurisdiction to enjoin or restrain the lockout. The National Basketball Association has also filed on August 2, 2011, a complaint with the National Labor Relations Board seeking an Order requiring the National Basketball Players Association to bargain in good faith.
