H-1B Professional Work Visas and Spousal Work Authorization through Executive Action

President Barack Obama will likely announce an executive action within the next few weeks that provides the opportunity for spouses of H-1B Visa holders in the US to apply for work authorization. Foreign citizens on H-1B Visas, US employers and immigration attorneys such as myself have been trying to have the US extend work authorization to spouses of H-1B Visa holders for years.

Enabling spouses to apply for work authorization would amount to a major change in the H-1B Visa Program. This article examines the rationale for and against extending work authorization to spouses of foreign workers in the US on H-1B Visas.
