NLRB Fiscal Year 2010 concludes...critical decisions and change

The NLRB's fiscal year ended September 30. The Board issued 265 publicly reported decisions of which 77 were 2 member decisions found invalid by the Supreme Court on June 17 and 78 were reconsiderations of invalid 2 member decisions issued since January 1, 2010. Notably, the NLRB has invited briefing on its apparent intention to overturn the Bush Board's 2007 decision allowing employees to vote by secret ballot to revisit an employer's voluntary recognition of a union based on signed cards. Key decisions are reviewed and an action plan is suggested for all employers - unionized and non-union.
