Hogan Lovells and Privacy Laws & Business have submitted a joint memorandum to data protection leaders in the EU and the UK advocating for a common framework for Binding Corporate Rules (BCR). The memorandum, submitted to the European Commission, the EDPB, the ICO and the UK Department for Digital, Culture, Media and Sport is the result of a recent workshop session aimed at identifying practical ways to harmonise the EU and UK approaches.

In particular, the memorandum provides suggestions such as the implementation of a system of mutual recognition of authorisations which would be complemented by a regulatory cooperation procedure between the EU and the UK. It also highlights various aspects of the BCR approvals and implementation processes that should be streamlined. In order to achieve the desired aim of strengthening the role of BCR as a model for global data protection, the memorandum appeals to the European Commission and the UK Government to empower all European data protection authorities to work as constructively as possible and align their positions.
