California Employers with 100+ Employees Should be Aware of Fast Approaching Pay Data Report Deadline

Snell & WilmerEmployers with 100 or more employees nationally and at least one employee in California are required to submit a pay data report to the Department of Fair Employment and Housing no later than March 31, 2021.  Similar to the Federal EEO-1 reporting requirements, in September 2020, California passed Senate Bill 973 which requires employers with California employees to annually submit employee pay and demographic data, including number of employees by race, ethnicity, and sex in specified job categories, the number of employees by race, ethnicity and sex whose annual earnings fall within specified pay bands, and the total hours worked by each employee counted in each pay band. If an employer does not submit the required report, the Department may seek an order requiring compliance and is entitled to recover its associated costs. Employers can access more information and submit their pay data report through the DFEH’s website: dfeh.ca.gov/paydatareporting.
