Bloomberg Law reported this week that California Attorney General Xavier Becerra expects to issue draft regulations for the California Consumer Privacy Act (CCPA) in October. Bloomberg reported that AG Becerra told reporters that the regulations would be published next month. Businesses and consumers will then be able to submit public comments to the regulations. Bloomberg also reported that AG Becerra plans to have the final regulations in place by January 1, 2020, the effective date of the CCPA.

What might the regulations address? CCPA §1798.185 gives the Attorney General broad rulemaking authority to establish rules and procedures for the consumer opt-out process, to develop a recognizable and uniform opt-out logo or button for the implementation of the “do not sell my personal information” link, to establish rules for consumer notices that are required by the CCPA so that they are easily understood by the average consumer, and are accessible to people with disabilities, to establish rules and procedures regarding verifiable consumer requests to facilitate a consumer’s request for information, and a catch all provision to adopt additional regulations as necessary to further the purposes of the CCPA.  We look forward to the release of the draft regulations.
