DC AG Continues Constructing Wage Theft Settlements

  • District of Columbia AG Brian Schwalb settled with Prestige Drywall LLC to resolve allegations that the construction company misclassified employees as independent contractors—resulting in the deprivation of overtime pay, sick leave, and other employment protections and benefits to which the workers were lawfully entitled—in violation of the District’s Workplace Fraud Act, Minimum Wage Revision Act, and Sick and Safe Leave Act.
  • According to the AG, Prestige Drywall employed more than 200 construction workers between 2020 and 2023 both through direct contracts and through subcontracts with other companies, and deprived those misclassified workers of more than $40,000 in overtime pay.
  • Under the terms of the settlement, Prestige Drywall must pay $359,665 in restitution to affected workers; pay $244,975 in penalties to the District; cease doing business in the District for five years; and undertake compliance measures, including implementing a certified payroll system and conducting audits of subcontractor payroll.
