  • A group of 23 Democratic AGs filed an amicus brief in support of the U.S. Department of Labor’s (DOL) minimum wage increase from $10.10 to $15 per hour for certain federal contractors.
  • The brief was filed in a case before the U.S. Court of Appeals for the Ninth Circuit, in which a group of Republican AGs challenged the DOL’s minimum wage increase under the federal Procurement Act, Administrative Procedure Act, nondelegation doctrine, and Spending Clause. The district court denied a preliminary injunction and dismissed the lawsuit.
  • In their amicus brief, the AGs argue that the Ninth Circuit should uphold the district court’s decision because, contrary to appellant states’ arguments, the major questions doctrine is not implicated by this case, and because the minimum wage raise is supported by social science and empirical data.
