EEOC Announces Data Collection Schedule

As we discussed in a previous alert, in May 2020, the Equal Employment Opportunity Commission (EEOC) delayed data collection in light of the COVID-19 public health emergency. Recently, the EEOC announced its plan to open data collection later this year. Employers with data reporting obligations should be aware of the following timetable:

Private Sector Employers: 2019 and 2020 EEO-1 Component 1 Data Collection will open in April 2021. The EEOC has not announced any change to its September 2019 announcement that it would not collect 2019 or 2020 EEO-1 Component 2 Data. 

Public Elementary/Secondary School Districts: 2020 EEO-5 Data Collection will open in July 2021.

Local Referral Unions: 2020 EEO-3 Data Collection will begin in August 2021.

State/Local Governments: 2020 EEO-4 Data Collection will begin in October 2021. 

Neither the precise opening dates, nor the submission deadlines for these data collections have been announced. We will continue to monitor and report as updates are available.
