In the aftermath of the Supreme Court loosening the design patent infringement standard, the past decade has seen a significant increase in design patents filed and obtained, along with an increase in design patent litigation. Our timely program will review these design patent protection trends and the interplay of design patents with other intellectual property protection schemes such as trade dress and copyright, as well as offer practical tips and identify pitfalls for Retailers and Consumer Product companies looking to leverage design patents but minimize any risks associated with obtaining such protection.
