Like the first robin in spring, here is what we believe is the first lawsuit challenging the “Persuader Rule,” issued last week by the U.S. Department of Labor. The suit was filed yesterday in federal court in Arkansas, and the plaintiffs include trade associations, the Arkansas Chamber of Commerce, and a law firm that provides labor-related advice to employers.
We feel sure that there will be more such lawsuits to follow. In case you’re planning to keep score, Arkansas is in the Eighth Circuit.
