On February 17, 2021, President Joe Biden nominated Jennifer Abruzzo to be General Counsel of the National Labor Relations Board (NLRB). Ms. Abruzzo was most recently a Special Counsel for Strategic Initiatives for the Communications Workers of America (CWA). Prior to her role with the CWA, Ms. Abruzzo worked for the NLRB for more than two decades, holding numerous roles, including the acting general counsel prior to Peter Robb’s confirmation in late 2017. With regard to Ms. Abruzzo nomination, The White House stated: “Abruzzo will be an important member in supporting the NLRB’s work to build a stronger, more resilient, and more inclusive economy that delivers every American a fair return for their work and an equal chance to get ahead.”

The U.S. Senate is anticipated to confirm Ms. Abruzzo’s nomination. Employers should be prepared for the NLRB to engage in an aggressive enforcement agenda under Ms. Abruzzo’s leadership.
