May 7th Effective Date Set For Federal Independent Contractor Rule

The U.S. Department of Labor announced a new effective date for the independent contractor classification test under the FLSA. The Final Rule, originally set for March 8, 2021, will now go into effect on May 7, 2021. Though not yet disclosed, we anticipate there will be changes to the Final Rule before its new May 7, 2021, effective date. This May 7th effective date is a light at the end of the tunnel for both employers and employees tracking this Final Rule, and it may signal issuance of other non-emergency rules and regulations in the near future.
