New Voluntary Self-Identification Form for Disability Released

The Office of Federal Contract Compliance Programs (OFCCP) published an updated Voluntary Self-Identification of Disability Form (CC- 305) on April 26, 2023. Federal contractors and subcontractors must begin using the new form by July 25, 2023.

The purpose of the form is to help employers measure progress towards the federally set, aspirational 7% disability utilization goal and must be completed by applicants during the applicant process, new hires after an offer of employment, and employees every five years. 

Employers may only modify the “For Employer Use Only” portion of the form for record-keeping purposes, such as adding job titles and date of hire information. Employers may not otherwise materially alter this form. 

Notable changes to the form include additions of disability examples like: 

  • Alcohol or other substance use disorder (not currently using drugs illegally) 
  • Disfigurement, for example, disfigurement caused by burns, wounds, accidents, or congenital disorders 
  • Mobility impairment, benefiting from the use of a wheelchair, scooter, walker, leg brace(s) and/or other supports 
  • Partial or complete paralysis (any cause) 
  • Pulmonary or respiratory conditions, for example, tuberculosis, asthma, emphysema 
  • Short stature (dwarfism)
  • Traumatic brain injury 

A language change from “psychiatric condition” in the previous form to “mental health condition” in the new form is also notable.
