Issues of digital privacy are multi-faceted and extend far beyond the now-routine data breaches that make headlines. The digital collection, use, and storage of biometric information (fingerprints, retinal or iris scans, voiceprints, facial geometry, and the like) are an often underappreciated source of liability exposure for corporations. Illinois has enacted the Biometric Information Privacy Act (BIPA), which provides a private right of action for employees and others against companies that allegedly have failed to properly handle their biometric information.
