  • Washington AG Bob Ferguson filed a lawsuit against O’Reilly Auto Enterprises, LLC accusing the auto part retailer of violating the state’s Healthy Starts Act, Law Against Discrimination, and Consumer Protection Act by refusing to reasonably accommodate its pregnant employees.
  • According to the complaint, O’Reilly routinely rejected pregnant employees’ requests for workplace accommodations, including the ability to sit or rest, flexible bathroom breaks, or limiting heavy lifting or the handling of hazardous materials. O’Reilly managers allegedly retaliated against employees who made accommodation requests, including forcing them to take unpaid leave, issuing them negative performance reviews, or even firing them.
  • AG Ferguson seeks a permanent injunction preventing O’Reilly from engaging in further unlawful conduct, as well as damages, restitution, and both standard and enhanced civil penalties.
