Courts have uniformly barred patent holders producing goods through subsidiaries from claiming their full amount of lost profits due to patent infringement. The court in St. Jude Medical, Inc. v. Access Closure, Inc. was the first-and currently the only-court to allow a parent corporation to seek damages based on its subsidiaries' lost profits.
