Deadline Extended for Filing 2018 EEO-1 Reports

The EEOC finally announced on February 1, 2019, that due to the government shutdown, the deadline for filing 2018 EEO-1 reports is extended from March 31, to May 31, 2019. EEO-1 reports collect employment data on gender, race, ethnicity and job categories. Private-sector employers with 100 or more workers, and federal government contractors or first-tier subcontractors with 50 or more workers and a contract or subcontract of $50,000 or more,​ must file an annual EEO-1 report. The reports are filed with and administered by the EEOC. Every January, the EEOC sends Notification Letters with instructions for filing to employers that filed EEO-1 reports in the past year. Since the EEOC was one of the federal agencies that did not operate during the government shutdown, no such Notification Letters were sent. Prior to Friday's announcement, questions remained as to whether the EEOC was going to postpone the March 31, 2019 filing deadline. The EEO-1 filing portal has been shut down; however, the EEOC announced it will be accessible beginning "in early March" and that details and instructions will be forthcoming. We recommend filers regularly monitor www.eeoc.gov/employers/eeo1survey/index.cfm for up-to-date information from the EEOC.
