EEOC Announces September Deadline for EEO-1 Pay Data Submissions

The U.S. Equal Employment Opportunity Commission (EEOC) announced on April 4, 2019 that all covered employers have until September 30, 2019 to comply with the requirement to collect and report pay data for 2017 and 2018. Covered employers are required to report their employees’ 2017 and 2018 W-2 compensation information and hours worked by this new deadline.

As we recently wrote, a federal judge in Washington, D.C. lifted a stay enjoining the requirement that employers complete the pay data collection component in the annual Employer Information Report EEO-1, otherwise known as the EEO-1 Report. Certain employers are required to file an EEO-1 Report each year with the EEOC Office of Enterprise Data and Analytics’ Employer Data Team.

Current EEO-1 Reports for other required data, which include information on race, ethnicity, and sex, are due by Friday, May 31, 2019. Barring additional court injunctions or other delays, covered employers should begin collecting pay data of their workforces and plan to timely complete their EEO-1 Reports by the May 31, 2019 and September 30, 2019 deadlines.
